Apple loses court case with the EC over application of special requirements under the Digital Markets Act

The European General Court has rejected Apple Inc.'s lawsuit contesting the European Commission's ruling to label it a "gatekeeper" under the Digital Markets Act (DMA).

This designation can be given to major digital firms offering platform services if they fulfill several criteria concerning, specifically, their size and market influence.

In September 2023, the European regulator designated Apple as a gatekeeper because of the significant role played by its App Store and iOS operating system. Gatekeepers serve as go-betweens for businesses providing online services and final users, thus they face specific responsibilities designed to promote fair competition.

"The court rejects all assertions brought by Apple and upholds the legitimacy of its role as a gatekeeper for the App Store and iOS," the court stated in a statement made public on Wednesday.

The DMA, effective since November 2022, mandates that designated companies adhere to several regulations. Apple contends that these demands threaten user privacy and security.
